ELTA計畫個人資料蒐集、處理及利用說明

Notification for collection, processing and use of personal data by English Language Teaching Assistant Program

教育部國民及學前教育署為辦理「協助國民中小學引進部分工時外籍英語教學助理計畫（下稱「本計畫」）」，與參與本計畫之聘任學校共同蒐集、處理、利用 臺端之個人資料，依個人資料保護法應明確告知 臺端下列事項：

In order to implement the English Language Teaching Assistant Program (hereinafter referred to as “the Program”), the K-12 Education Administration, Ministry of Education and the participating schools will work together to collect, process and use your personal data. In accordance with the Personal Data Protection Act, you should be clearly informed of the following:

一、 個人資料之處理及權利行使
Processing of personal data and exercising of rights

（一） 本計畫係於符合法令規定之情況下，蒐集、處理及利用 臺端之個人資料，包括但不限於依法令規定、於契約或類似契約之特定目的範圍內、 臺端同意等情形。
The Program will collect, process, and use your personal data in accordance with the requirement of law, including but not limited to the situation of compliance with a legal obligation, within the scope of a contract or quasi-contract, based on your consent, and etc.

（二） 臺端得自由選擇是否提供相關個人資料，惟 臺端所拒絕提供之相關個人資料如果是參與本計畫所必需之資料，有可能使 臺端無法參與本計畫或進行必要之處理作業。
You may decide whether or not to provide the related personal data. However, if the data you refuse to provide is necessary for you to participate in the Program, your refusal may prevent you from participating in the Program or carrying out the necessary processing operations.

（三） 如前揭執行方式係取得 臺端同意時， 臺端得隨時撤回該同意，惟不影響撤回前本計畫基於同意所為之蒐集、處理或利用行為之合法性。
Where the preceding performance is based on your consent, you shall have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of collection, processing or use of the Program based on consent before its withdrawal.

（四） 請 臺端提供本計畫正確、最新及完整之個人資料，且於個人資料有異動時，主動向本計畫申請更正，使其保持正確、最新及完整，若提供之資料有錯誤、不實、過時、不完整或具誤導性之情況時，將可能損及 臺端相關權益。
Please provide your accurate, latest and complete personal data, and inform the Program of any change of your personal data to maintain the latest information. You may lose certain rights or benefits if you provide incorrect, untrue, outdated or incomplete information.

（五） 臺端可向本計畫行使以下權利：
You are entitled to make the following requests to the Program.

1. 請求查詢、閱覽、製給複製本、補充或更正。
To check, review, receive a photocopy, supplement or revise of the collected data.

2. 請求停止蒐集、處理或利用（撤銷同意）。
To cease the collection, processing or use of the collected data (To withdraw consent).

3. 請求刪除（遺忘）。
To delete the collected data (Right to be forgotten).

（六） 端充分了解，本計畫因法令規定、執行職務或業務所必需持有之資料者（如稅捐、居留證、工作許可等要求），將無法予以刪除，但如收到 臺端前述請求，將依據請求停止後續之蒐集、處理或利用。
You are fully aware that it is not possible to delete data that is required by law or necessary for the performance of your duties or business (e.g. tax, residence certificates, work permits, etc.). However, if we receive the aforementioned request from you, we will cease any further collection, processing or use of such data upon your request.

二、 蒐集個人資料之目的
Purpose of personal data collection

（一） 本計畫係基於下述特定目的而蒐集、處理及利用 臺端之個人資料：
The Program collects processing and use your personal data base on these specific purposes:

1. 031 全民健康保險、勞工保險、農民保險、國民年金保險或其他社會保險

3. 069契約、類似契約或其他法律關係事務
069 Contract, contract-like or other legal relation matters

4. 073政府資訊公開、檔案管理及應用
073 Freedom of government information, archives administration and management

5. 109教育或訓練行政
109 Education or Training Administrative

6. 129 會計與相關服務
129 Accounting and related services

7. 136資（通）訊與資料庫管理

（二） 當本計畫蒐集、處理或利用 臺端之個人資料，已逾原蒐集之目的時，將會在辦理前徵求 臺端之同意，惟當 臺端拒絕同意時，可能因此喪失相關權益或無法使用本計畫所提供之服務。
The Program will solicit your consent in a written form in advance before collecting, procession or using your personal data to serve a purpose other than the one specified above. But, if you refuse to give consent, you may lose certain rights or benefits consequently or not able to obtain services from the Program.

三、 蒐集之個人資料類別
Categories of personal data collection

（一） 本計畫將視業務需要，蒐集 臺端下列之資料類別，惟實際蒐集、處理及利用之資料，仍以本計畫提供之實際業務為 collected, processed and used will depend on the actual operation by the Program.

1. 識別類

(1.) C001辨識個人者
C001 Type for identifying individuals
例如：姓名、職稱、通訊及戶籍地址、行動電話號碼、電子郵件地址等任何可辨識資料本人者。
e.g. name, title, postal and resident address, mobile phone number, e-mail address, and any other information by which individual can be identified.

(2.) C002 辨識財務者
C002 Type for identifying finance data
例如：金融機構帳戶之號碼與姓名。
e.g. Account name and account number of the financial institution.

(3.) C003政府資料中之辨識者
C003 Type for identifying in government data
例如：身分證統一編號、居留證或永久居留證統一證號、護照號碼。
e.g. the number of personal ID card, the number of ARC or APRC, the number of passport.

(1.) C011 個人描述

例如：年齡、性別、出生年月日、出生地、國籍等。
e.g. age, gender, date of birth, place of birth and nationality, etc.

例如：緊急聯絡人資訊
e.g. emergency contact information, etc.

4. 社會情況
Social conditions

(1.) C041 法院、檢察署或其他審判機關或其他程序
C041 Courts, the Public Prosecutor's Office or other trial-related departments and procedures.
例如：警察刑事紀錄證明書等。
e.g. Police Criminal Record Certificates, etc.

5. 教育、考選、技術或其他專業
Education, examination, technique or other profession

(1.) C051學校紀錄
C051 Schools record
例如：大學、專科或其他學校等。
e.g. universities, colleges or other schools, etc

(2.) C052 資格或技術
C052 Qualifications or special skill
例如：英語檢定考試成績。
e.g. English proficiency test scores

(3.) C057學生（員）、應考人紀錄
C057 Record of students, apprentices, Examinees
例如：考試訓練考核及成績、評分評語或其他學習或考試紀錄等e.g. related qualifications and certificate, the score and evaluation in the examination, etc.

6. 受僱情形
Employment

(1.) C061現行之受僱情形
C061 Current status of employment
例如：工時、與現行僱主有關之以前責任與經驗等。
e.g. working hour, the previous liabilities and experiences related to the existing employer, etc.

(2.) C064 工作經驗
C064 Work Experience
例如：以前之工作情形。
e.g. previous work experience.

7. 財務細節
Financial Detail

(1.) C093 財務交易
C093 Sinancial transactions
例如：收付金額與支付方式。
e.g. payment amount and payment method.

四、 個人資料利用之期間、地區、對象及方式
Time period, areas, parties and manners of using personal data

（一） 期間
Time Period

1. 蒐集個人資料特定目的之存續期間，為本計畫執行期間及依法令必須持有之期間。
The retention period for the collection of personal data for specific purposes is the duration of the Program and the period required by law to retain such data.

2. 依相關法令所定（例如個人資料保護法等）或因執行業務所必須之保存期間或依個別契約就資料之保存所定之保存年限（以期限最長者為準）。
The retention period agreed in the data retention period required by laws and regulations (e.g. Personal Data Protection Act), or the retention period in accordance with its needs or respective contracts (the longer period to be applied).

（二） 地區
Areas

1. 下述(三)對象所列之利用對象其所在地。
Any jurisdictions where the entities described in the following paragraph “(III) Parties” are located.

（三） 對象
Parties

1. 本計畫主管機關（例如教育部教育部國民及學前教育署）。
Supervisory authority (e.g. K-12 Education Administration, Ministry of Education.)

2. ELTA教育資源中心。
The ELTA Center(s).

3. 地方政府。
Local government(s).

4. 參與本計畫之國民中小學。
Elementary School(s) or Junior-high School(s) which attended the Program.

5. 臺端所同意之對象。
Parties agreed by you.

（四） 方式
Manners

1. 符合個人資料相關法令以自動化機器或其他非自動化之利用方式之蒐集、處理、國際傳輸與利用（例如：使用電子文件、紙本或其他合於當時科學技術之適當方式等）。
The personal data will be collected, processed, used, and internationally transmitted through automatic machine or non-automatic methods (e.g. via electronic documents, paper format, or other appropriate manners conform to the technology available at that time) in compliance with the relevant laws and regulations.

五、 個人資料侵害事件之處理
Processing of personal data breach incident

（一） 本計畫如因違反相關法令規定、天災、事變或其他原因，致使 臺端之個人資料遭意外或非法破壞、遺失、變更、未獲授權之揭露或接近使用者，本計畫將於查明後以電話、信函、電子郵件或網站公告等方法，以適當方式通知。
Should your personal data be stolen, unauthorized disclosed, altered or infringed upon due to the violation of applicable law, or the occurrence of any natural disasters, incidental changes or other circumstances, the Program shall inspect the cause and inform you by phone, mail, email or website notice.

六、 申訴管道
Complaints

（一） 為妥善處理個人資料相關事宜，由本計畫教育部國民及學前教育署委辦之ELTA教育資源中心（北區）提供溝通諮詢與查詢管道， 臺端並得以書面、電話、電子郵件提出查詢、請求或申訴，相關聯絡資訊如下：
To handle personal data matters properly, the ELTA Education Resource Center (ELTA North Center), commissioned by the K-12 Education Administration to administer the Program, provides communication and consultation channels. Inquiries, requests or complaints may be made in writing, by phone or by e-mail using the following contact information:

七、 本計畫有權修訂本告知事項，並於修訂後以言詞、書面、電話、簡訊、電子郵件、電子文件、網站公告或其他足使 臺端知悉或可得知悉之方式告知。如果 臺端不同意修改之內容，請向本計畫主張停止蒐集、處理及利用個人資料。
The Program may amend this Notification at any time, and notify you the amendments orally, in writing, or by telephone, text messaging, e-mail, electronic documents, website announcement, or other methods that may give you direct or constructive notice regarding the amended matters. Should you disagree with any amendments, please exercise your right to request that The Program discontinue to collect, process or use your personal data. Otherwise, you are considered to have agreed to the amendment.
